Does Canada’s Charter of Rights and Freedoms no longer apply?
Normally I wouldn’t even consider such a question, but we are not living in anything remotely resembling normal times.
Over the past many weeks I’ve seen a number of people and organizations (GameOnCanada.org, Action4Canada.org, CelebrateRights.net) claiming various government edicts are a violation of our Charter rights. They go so far as to share documents to place employers on notice that they’re liable for any damages resulting from their “No Vaccination – No Job” policies.
While I believe these individuals and groups are correct, I also know being correct means nothing unless a judge in a court of law says you are correct.
Only then is there a glimmer of hope to force the government to back down.
And that’s the problem all of these groups and the lawsuits they’ve filed now face: finding a judge who will uphold the Charter.
So far, the only judge I’ve seen claim COVID does not usurp every other law of the land is BC Supreme Court Justice Geoffrey B. Gomery, who informed over-zealous Crown Prosecutors that whether a juror was vaccinated or not was none of their business.
Justice Gomery ruled an individual’s right to privacy was more important than the Crown Prosecutor’s desire to learn whether potential jurors took the COVID vaccine.
“The proposed question as to vaccination status trenches on a private and personal sphere. Panellists might well have reasons to wish not to discuss their vaccination status in public in the intimidating environment of a courtroom. Some might be intimidated by the question itself. Offering an assurance that they need not reply would mitigate, but not eliminate, the pressure.”
In every other case I’m aware of, where an individual or group has challenged COVID restrictions, the judge has ruled COVID and the restrictions government imposes on us in their quest to “end the pandemic” outranks every single one of our Charter Rights.
As you may imagine, I take great issue with this position for a variety of reasons.
The Charter is supposedly the highest law of the land, yet I cannot find a single judge anywhere in Canada that upholds our Charter rights against COVID and fear of it.
Is COVID real?
Of course it is. Only a complete fool or a person wilfully blind to the facts would say otherwise. But like every other flu, it primarily kills the elderly (with serious pre-existing health conditions) and other people who are already in ill health.
Here in British Columbia, the median age of those who died from COVID is 84 (see table on page 9) which, ironically, is two years higher than the median age of life expectancy – 82.1.
With rare exceptions, COVID does not kill young people or anyone without already serious medical issues.
COVID is, despite the 24x7x365 fear propaganda to promote its deadliness, remains about as dangerous as any other seasonal flu. Statistics Canada mortality rates make that fact abundantly clear. For the past 5 years, the annual mortality rate is almost unchanged – meaning COVID is not the deadly mass killer our governments insist it must be.
But the non-stop campaign of fear led by both government and mainstream media outlets since early 2020 means most Canadians have simply given up. They’ve been beaten down. When every single newscast leads off with COVID case numbers (despite being all but meaningless because of PCR test cycle rates) it’s hard to maintain a strong sense of self and a strong sense of right and wrong.
Governments always seek more control over individual lives.
Without exception.
This is why every other treatment option (and there are many) and simple ways we can take better care of ourselves (eat right, exercise, Vitamin D for those who are deficient — and everyone above the 49th parallel is Vitamin D deficient for at least 6 months of the year) are verboten.
It’s not about our health.
It’s about control. Control over our lives, where we shop, where we eat and who we associate with.
It’s always been about control – with the possible exceptions of that first “2 weeks to flatten the curve” – but I’m convinced this too was about control. How far can governments go before mere citizens push back.
I think every government in the world was stunned to see just how far they could push us before even a tiny percentage would push back.
Fear is a powerful motivator… arguably the most powerful motivator for every human being. And if you find yourself becoming angry with what I’ve said here today, I encourage you to ask yourself if fear is at the root of that anger. Why? Because it probably is.
The data I quote is from the Government of British Columbia website, so when I say the median age of a person dying from COVID in this province is higher than the media life expectancy, I’m not making it up. It is a fact.
If you are upset at my statement that treatment options other than the vaccine that is touted as the only solution – I encourage you to ask yourself why every level of government and every major social media platform is determined to stifle ANY and ALL discussions from such slackards and non-conformists as licensed doctors and nurses.
Why are they being silenced? Is it because they have nothing useful to offer? Or is it because what they say would shine a light on the deception and treachery our government placed us under almost two years ago and adamantly refuses to let go of?
Every COVID death is tragic – just as every death from the seasonal flu is tragic – just as every death from any virus or disease is tragic.
But we don’t destroy our society over the seasonal flu or cancer, so why are we allowing our government to destroy our society over COVID and segregate us based on whether or not we’ve received an experimental vaccine?
If COVID were as deadly as the government and the media keep insisting it is, why do they run the PCR test at a cycle rate so high it practically guarantees a positive result?
If COVID were truly as deadly as the government and media keep insisting it is, why is our national death rate almost identical for the past five years – and not double or triple that rate?
These are simple questions to answer – but only if you can set aside the government-induced fear and take a look at the data with an open mind.
And that – an open and critical mind – is precisely what is lacking from every judge at every level of the judiciary so far. The fear of COVID is the disease running rampant in our society, and it will stop eventually. It must stop, because we literally cannot survive as a species if it doesn’t.
I won’t lie. There are points over the past two years where fear ruled me too. But I’m thankful those times were few and far between, and I remain willing to examine the facts, the evidence, and the experience of those doctors and nurses who specialize in treating these types of viruses while asking myself one simple question:
Why are governments and media outlets so determined to silence them?
It’s a question I hope you ask yourself too.

The CDC has decided to quit using the PCR test because it gives more false positives than actual. BUT – not until December! So the farce goes on and on and on…

Hi Christopher, It’s been a while, but I felt compelled to comment my two bits worth.
I can honestly say that I have given this fear porn thing some thought, and it never got to me! I agree that Covid is real, but as you say, this is about power and control, not safety, and I realized that almost immediately, and that has guided me through this entire three ring circus.
I am perplexed at how many simply accept the lies and fear without thinking logically. Of course I quit watching the MSM a long time ago, as I figured out they were lying and manipulating, not news casting. It has made me realize I am far better mentally adjusted than I knew, and it really didn’t get to me.
I found and find, the masks stupid and annoying, as they are useless, but serve as a dutiful compliance indication. Any biz that required it, I put it on, but jeez, when you see people jogging with them on, and slathering the sanitizer on, it’s so idiotic.
I have no problem if someone wants to be vaccinated, but I do have a problem with them demanding I be vaccinated as well.
The pressure to be vaccinated is also a tell, that there is more going on than a “pandemic”. Unfortunately, we little folk have no voice or say, without protesting, and I see the judges as either complicit or useful idiots, but it does show us that the charter was designed to manipulate us, and worded with weasel clauses that benefit the ruling class.
They get to rule and we are supposed to obey, and they don’t like it when we want to think for ourselves. The Kipling poem, Wrath of the Awakened Saxon, comes to mind. The rulers are elected, not anointed or royalty, and they best start remembering that, or things could get ugly. Sadly, I see a dark decade ahead for us all.
Chris, your article is very timely. We are rapidly approaching a point of no return and I hope that people who read the questions you pose finally results in a mental exercise that breaks through the cognitive dissonance from which so many people now suffer.
Our Charter Rights and Freedoms have been replaced with manufactured flu hysteria. And that hysteria is the stick we are all being beaten with to force our obedience to a globalist kakistocracy. Our judiciary is fully compromised and is in lockstep with our wannabe overlords. If they can’t get your obedience through draconian restrictions, forced unemployment and starvation, they will get it through the courts. For example, pastor Artur Pawlowski now has a court ruling which compels him to denounce his own beliefs every time he posts to social media or speaks publicly. He is also not allowed to leave Alberta for 18 months. Charter violations invoked by a judge?
Chris … I was negligent in replying to your article about the things for which we need to be thankful. In addition to loved ones, sound health, food and a warm bed, I must say that I’m most thankful for being part of an ever shrinking part of the population that is still capable of reasoning. The ability to reason is what makes us children of God and provides us with our humanity. The ability to reason is also the mind’s bullshit filter.
Seriously, what we are living through has little to do with politicized public health scares, profitability science, kangaroo justice or the illusions of elections and partisan politics. It is a battle between Evil and Good. This is a war on all of humanity, the outcome of which is inevitable.

The charter is the ruling law and there should be no other laws that supersede it. Those laws are for our protection to prevent what is happening to us now.
Are these politicians and health officials really that stupid or just on a power trip? The provincial and federal supreme courts should be all over these violations. Why are they silent? Were they paid off or are they just stone cold cowards?
I believe the charter does not apply to government so they do what they please. The charter applies to us, the people, and we have to fight the government in court to uphold our rights. If we don’t, good bye rights and freedoms.
There is a large group of individuals, can’t be small because this is worldwide, who are responsible for this created crisis who need to be accountable for their crimes against humanity.
Both Henry Kissenger and David Rockefeller, who are population reduction advocates, quoted that crisis’s need to be “CREATED” to achieve the new world agenda. 911 is a good example of a created crisis. Rockefeller even dared to use a virus to achieve the agenda. So here we have it.
An act of GOD or mother nature? Not a chance. More like an act of man or human nature.
I can’t speak to WHY no judge will uphold the Charter, but it appears no level of government will stop violating our rights until one does. I find it difficult to believe these smart and intelligent people of the judiciary are ALL cowed by fear, though, so there must be some other answer.
